ACTION REQUESTED:

Adopt the amendment to the Personnel Resolution that includes an update to Addendum #3 - Drug and Alcohol Free Workplace Policy Applicable to Covered Mass Transit Employees and Applicants for Such Positions.

PRIOR BOARD ACTIONS:

None

BACKGROUND:

Regulations applicable to mass transit employees employed in the Transportation Department require a separate policy addendum to include all applicable compliance with USDOT-FTA drug and alcohol testing. In May 2023, USDOT issued an update to the drug and alcohol testing regulation (49 CFR Part 40) which became effective June 2023. This final rule amends the DOT’s regulated industry drug testing program to include oral fluid drug testing. This change impacts the current mass transit drug and alcohol policy (Addendum #3). The proposed update and action to amend the county’s policy will adopt the required language and comply with the new DOT regulation.

FINANCIAL IMPACT:

None.
