ACTION REQUESTED:

Conduct public hearing for proposed rezoning

PRIOR BOARD ACTIONS:

None

BACKGROUND:

This case is a request to rezone a 5.75 acre portion of a 17.21 acre parcel appearing on the tax map as tax parcel 09-384-013 located on South Rocky River Road from RA-40 to Light Industrial (LI) with Conditions. The rezoning request is a conditional rezoning, and includes the following conditions:

1)                     Limited to approved site plan dated April 6, 2026

2)                     Uses limited to office, warehouse and construction equipment and material storage

3)                     5.75 acre portion will be subdivided from parcel

4)                     Five-year vesting of development rights

5)                     Development will meet all requirements of the Union County Unified Development Ordinance on the date of approval

 

The Land Use Board unanimously recommended approval at its May 19, 2026 meeting, citing consistency with the Land Use Map and increased business opportunities.

 

If the Board of Commissioners wishes to make a decision on this rezoning petition, it can consider the following motions:

 

To approve the proposed amendment (the proposal is consistent with the current plan)

Motion

(i) Adopt the Ordinance Approving Revision to the Official Zoning Map of Union County, North Carolina, and (ii) adopt the consistency and reasonableness statement for approval.

To deny the proposed amendment (the proposal is inconsistent with the current plan)

Motion

(i) Deny rezoning petition CZ-2026-005 from Jeremy McAteer; and (ii) adopt the consistency and reasonableness statement for denial.
