2) September 20, 2021, Regular Meeting, Agenda Item # 10 - Approved Brown and Caldwell Task Order 2017-09 for additional engineering services related to easement acquisition for the project.

3) March 20, 2023, Regular Meeting, Agenda Item # 23-193 - Adopted Resolution authorizing condemnation to acquire certain property or interest in property for temporary construction easements and permanent utility easements for twenty-seven (27) parcels.

BACKGROUND:

The Capital Improvement Program, as adopted by the Board of County Commissioners (BOCC), includes an allocation for the design and construction of system improvements within the Crooked Creek Basin to expand hydraulic capacity in the collection system along the Highway 74 corridor, including the Crooked Creek Interceptor Improvements Phase II project. The Crooked Creek Interceptor Improvements Phase II project consists of the replacement and upsizing of approximately 14,300 linear feet of the Crooked Creek Basin trunk sewer with new 18-inch, 24-inch, and 30-inch gravity sewer piping from the Crooked Creek WRF to the receiving manhole of the Forest Park Pump Station force main near Chestnut Parkway.

On August 3, 2020, the BOCC approved Brown and Caldwell Task Order 2017-05 in the amount of $635,537.00 for engineering design services. On September 20, 2021, the BOCC approved Brown and Caldwell Task Order 2017-09 in the amount of $176,486.00 for additional engineering design services related to easement acquisition. On March 20, 2023, the BOCC adopted a resolution authorizing condemnation to acquire temporary construction easements and permanent utility easements for twenty-seven (27) parcels.

On January 11, 2024, Union County Procurement Division received and opened nine (9) bids for the project. All bids were reviewed and certified by the engineer per the attached award recommendation letter and bid tabulation. Based on the engineer’s review and Procurement Division approval of the bid, UCW engineering staff recommends that the project be awarded to the lowest responsive, responsible bidder, Metra Industries, Inc., in the amount of $16,853,595.45.

To support the construction of the project, construction administration services are required to ensure the project is constructed to meet the requirements set forth in the project plans and specifications. The scope of services for construction administration, inspection, and miscellaneous testing identified in the attached Brown and Caldwell Task Order 8381-01 has been reviewed by UCW engineering staff and is appropriate for the project. Services are to be provided on a per diem basis in the not to exceed amount of $1,346,590.00.

The total project cost is higher than the budgetary allocation for the project, which was started in 2020. The higher total project costs are associated with the current construction climate of escalated labor and material costs as well as delays in the project schedule due to easement acquisition. Capital Project Ordinances 244B, 312B, 320B, 326C, and 362 are needed to allocate the remaining necessary funding for the project.

FINANCIAL IMPACT:

Funding is available within the water and sewer capital fund, with $690,954.00 from unallocated funds from prior capital project closures and $2,809,046.00 from the reduction in other capital project appropriations, to support Capital Project Ordinances 244B, 312B, 320B, 326C, and 362 to provide the additional $3,500,000 for construction of the Crooked Creek Interceptor Improvements Phase II project.

With the adoption of Capital Project Ordinances 244B, 312B, 320B, 326C, and 362, funding is available within the Crooked Creek Basin Improvements Program to support the construction contract amount of $16,853,595.45 with Metra Industries, Inc. and the construction administration services described in Brown and Caldwell Task Order 8381-01 in the amount of $1,346,590.00.
