Kroger Opioid Settlement Participation
body
INFORMATION CONTACT:
Patrick Niland, Deputy County Manager, 704-283-3630.
ACTION REQUESTED:
Adopt resolution authorizing County Manager to execute all documents necessary for the County to participate in the Kroger National Opioid Settlement.
PRIOR BOARD ACTIONS:
None.
BACKGROUND:
A new proposed national opioid settlement has been reached with Kroger. North Carolina is participating in the Kroger Settlement. The settlement Participation Package attached to this agenda item must be submitted on or before August 12, 2024, in order for the County to be considered for initial participation calculations and payment eligibility. Based upon subdivision participation forms received on or before August 12, 2024, the subdivision participation rate will be used to determine whether participation is sufficient for the settlement to move forward and whether a state earns its maximum potential payment under the settlement. If the settlement moves forward, release of funds to the County will become effective. If a settlement does not move forward, that release will not become effective. Nonparticipation may also reduce the amount of money for programs to remediate the opioid crisis in its state. Decisions on how settlement funds will be allocated within a state are subject to the North Carolina Second Supplemental Agreement for Additional Funds from Additional Settlements of Opioid Litigation (SAAF-2), a supplement to the North Carolina Memorandum of Agreement (MOA) on the allocation, use, and reporting of funds from the prior Wave One and Wave Two opioid settlements.
FINANCIAL IMPACT:
Union County is estimated to receive up to $500,463.30 total out of the Kroger settlement between FY25 and FY34.
